{Abridged from the Sydney Morning Herald.)
TUESDAY, NOVEMBER 19, 1878
Charles William Crawshaw and Johanna Crawshaw, were charged with, on 2nd July, 1878, at Bombala, feloniously setting fire to a certain dwelling-House belonging to Charles William Crawshaw, two men named Hickey and Wallis being in the building; and a second count charged them with ordinary arson, with intent to defraud the United Insurance Company. Prisoners pleaded not guilty and were defended by Mr. Butler, Q.C., and Mr Bennett instructed by Mr. Blaxland, assisted by Mr. Faithfull. The evidence was to the effect that the prisoners took the house, a Hotel, in 1877 for five years at £200 per year. They afterwards complained that they had made a bad bargain. On the night of the fire Crawshaw who was suffering a recovery from a drinking bout was stopping at a house opposite the hotel, with a man named Wallis who had first been charged before the bench as the incendiary. A quantity of cases of kerosene had been placed in the billiard room the night previous to the fie. The bar was locked up by Agnes Dungate, a servant who placed the key on a chest of drawers in Mrs Crawshaw's bedroom. Mrs Crawshaw was in bed and her two children with her. Mrs. Crawshaw was the first to give the alarm of fire; she awoke the two servant girls and told them to get the children out, that the house was on fire. The girls found the children asleep, though Mrs. Crawshaw said at the coroner's inquiry that the children first awoke her. One of the girls awoke the lodgers and described the articles of apparel and linen she had found burning in the parlour. Among them wore a tablecloth which she had placed in a drawer the night before, and table napkins which had been taken from the rings, and the rings left in the drawer. Portion of a sheet was also burnt. After the fire the bed clothes were missed off Mrs, Crawahaw's bed and on one of the girls asking where she was to get a counterpane, Mrs. Crawshaw said "that those who set the place on fire must have seized tbe counterpane off her bed when she was asleep." Both girl's deposed to seeing a nightdress belonging to Mrs. Crawshaw with fresh stains of kιrosθne upon it, One kerosene tin was found after the fire with holes perlorated in the bottom of it, Mr. Crawshsw was awake twice before the fire though he was sleeping opposite, and when the alarm was given he and Wallis went over and helped to extinguish it. It was also proved that previously Crawshaw had threatened to burn his place down if it did not pay him better. Mr. Bennett the agent of the Union Insurance Society was of the opinion that Crawshaw would have been a heavy loser if the place had been burnt down, and the goods in the house were worth more than they were insured for. A valuation made for an intending purchaser corroborated this opinion. His Honor thought that the first count might be abandoned, as even if Mrs.Crawshaw did set fire to the place she was the first to give the alarm. Both Mr Butler and Mr. Want thought that the point, as one of law, could not be abandoned. His Honor thought perhnps not, but the point was only a nominal one, Mrs. Badgery, in to whose house Mrs. Crawshaw went after the fire, when she had only her nightdress on and a shawl, did not notice any smell of kerosene on the nightdress, or on the bed afterwards.
The Court resumed on Wednesdny morning, when Mr. Butler commenced his address which lasted three hours. Mr. Wane replied at considerable length, and his Honor, in summing up, went through the whole of the evidence. The jury retired at twenty minutes to 6, and at twenty minutes to 8 returned into Court with a verdict of guilty against both prisoners on each count. Being asked what they had to say in extenuation of sentence, the female prisoner, whose fortitude had been rapidly giving way towards the close of the trial, swooned, and the male prisoner burst into a torrent of tears, but neither made any reply. His Honor said that the prisoners, having been found guilty on the first count, left him no alternative but to pronounce the sentence of death on them; but be did so as a matter of form. It was clearly shown that the female prisoner had raised the alarm, of fire before the lives of the people in the house were imperilled, and hence there could have been no attempt to endanger life. He should take the recommendation of the jury into consideration in reporting to the Executive, and recommend adiminution of the term of imprisonment. He then passed formally the sentence of death. The Court was crowded during the two day hearing and more than ordinary interest evinced in the trial by reason of the respectable position held by the accused in the Monaro district.

SMH Wednesday, December 4, 1878

IT will be remembered that during the recent sittings of the Central Criminal Court at Darlinghurst three persons were sentenced to death. Two of these criminals were Charles William Crawshaw and Johanna Crawshaw, husband and wife, who were convicted of setting fire to their dwelling house at Bombala while two men were in the building, and, on a second count, of ordinary arson, with intent to defraud the United Insurance Company. The sentences of death passed upon them have been commuted at a meeting of the Executive Council as follows: The male prisoner to undergo seven years' hard labour on the roads; the female prisoner, three years' hard labour.

Notes: Eva's homestead in Orbost was called "Loretta ". She was a fascinating woman with many tales to tell. (some true and many untrue) However that mix made her an interesting character. Many of her stories were about her overseas travels. I can recall sitting in the lounge room in McLeod Street, Orbost, listening in awe of the places she had been and the people she had met. One big porky was of having met with the Pope and having her rosary beads blessed. According to Eva she had a private audience.
Other memories include her telling John (Reginald John Kerr) the reason she had no children was that on her honeymoon, the crucifix above the bed fell on husband, Jack's head and that was a sign from God. In her latter years (late 80's) she thought she was Queen Victoria and waved royally to people as she drove her little red Mini Minor around Delegate. (by: Pam McAllister)
